1. Who these terms are with
ChessBinder is operated by the ChessBinder team, operating from India. In these terms, “we”, “us”, and “our” mean ChessBinder and the people who own and operate it; “you” means the person using the service, and where an account belongs to a child, the parent, guardian, or coach responsible for it.
2. Accepting these terms
By creating an account, or by using ChessBinder in any way, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service. If you are accepting on behalf of an academy, school, or club, you confirm you are authorised to bind it.
3. Eligibility, children, and supervised accounts
You must be at least 18 years old to create an account for yourself. Children are welcome on ChessBinder, but a child’s account must be created and supervised by a parent, guardian, or by a coach who has the parent’s permission.
If you create or supervise an account for a child, you confirm and agree that:
- you are an adult and are the child’s parent or guardian, or you have that parent’s or guardian’s permission to create and manage the account;
- you consent, on the child’s behalf, to the processing described in our Privacy Policy and the Children & Parents notice;
- you are responsible for the child’s use of the service and for supervising it; and
- if you are a coach or academy, you will keep a record of the parental permission you obtained and produce it to us on request, and you will tell the parent that this notice exists.
We may suspend or delete any account we reasonably believe belongs to a child without a responsible adult behind it.
4. Your account
Give accurate registration details, keep your password confidential, and tell us promptly through the contact form if you think someone else has access to your account. You are responsible for activity that happens under your account. One person, one account: do not share credentials or run multiple accounts to gain an advantage on leaderboards.
5. Acceptable use
When using ChessBinder, you agree not to:
- use chess engines, solvers, other people, or any external assistance during a daily challenge, Grand Prix, or any other scored activity;
- create multiple or automated accounts, or manipulate scores, rankings, or rewards in any way;
- scrape, crawl, bulk-download, or systematically extract content or data from the service, or use it to train a machine-learning model, without our prior written permission;
- copy, republish, mirror, frame, or resell any part of the service or its content outside what these terms allow;
- upload or share content that is unlawful, infringing, harassing, hateful, sexual, or otherwise harmful, especially given that children use this service;
- attempt to breach security, probe for vulnerabilities without permission, interfere with other users, or overload our infrastructure;
- impersonate anyone, or misrepresent your relationship to a learner or an academy; or
- use the service for any unlawful purpose or in breach of any applicable law.
Found a security vulnerability? Please report it privately through the contact form rather than exploiting or publishing it. We will not pursue good-faith researchers who do so.
6. Your content
You keep ownership of the studies, annotations, notes, lessons, courses, and other material you create on ChessBinder (“your content”). You are responsible for having the rights to everything you upload.
So that we can actually run the service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, and transmit your content, for the purpose of operating, securing, and improving ChessBinder. Where you choose to publish content, or opt in to letting your published studies appear in daily challenges, that licence extends to displaying it to other users and, for public content, to the public — including in leaderboards, previews, and promotional material for the service. This licence lasts only as long as we host the content, and ends when you delete it, except for copies retained in routine backups until they rotate.
We may remove or restrict content that breaches these terms, infringes someone’s rights, or is unsuitable for a platform used by children.
7. Our content and intellectual property
ChessBinder, its name and logo, its software, design, text, curated puzzle sets, lesson material, and the selection and arrangement of everything on the site are owned by ChessBinder or licensed to us, and are protected by copyright, trademark, and other laws. We grant you a personal, limited, non-transferable, revocable licence to use the service for your own chess study, coaching, or learning — and nothing more. All other rights are reserved. 8. Coaches, academies, and classes
If you use ChessBinder to coach, you are responsible for your relationship with your learners and their parents, including any fees, cancellation terms, and attendance policies you set. We provide the tools; we are not a party to your coaching arrangement and do not supervise your teaching. You must handle learner information you see on ChessBinder confidentially, use it only for coaching that learner, and comply with the data-protection law that applies to you.
9. Fair play, leaderboards, and rewards
Leaderboards, challenge scores, and any rewards are administered by us and our decisions about them are final. We may adjust or remove scores, exclude an account from leaderboards, withhold a reward, or suspend an account where we reasonably believe there has been cheating, engine assistance, multiple accounts, or other manipulation. Rewards have no cash value unless we say otherwise in writing.
10. Availability and changes to the service
We work to keep ChessBinder available, but it is provided as-is and may be interrupted for maintenance, upgrades, or reasons outside our control. We may add, change, or discontinue features. If we discontinue the service entirely, we will give reasonable notice so you can export or delete your content.
11. Fees
ChessBinder is currently provided free of charge. If we introduce paid plans, we will publish the prices and payment terms before you are asked to pay, and no charge will apply to you without your express agreement.
12. Suspension and termination
You may stop using ChessBinder and ask us to delete your account at any time through the contact form. We may suspend or terminate an account that breaches these terms, that creates a risk to other users — particularly children — or where required by law. Where it is reasonable to do so, we will tell you why and give you an opportunity to respond.
13. Disclaimers
To the fullest extent permitted by law, ChessBinder is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted or error-free, that chess analysis, puzzle solutions, or ratings will be free of inaccuracy, or that any particular improvement in your chess will result from using it. Nothing in these terms excludes any liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
14. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, goodwill, data, or content, arising out of or relating to your use of ChessBinder. Our total aggregate liability arising out of or relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or INR 5,000.
15. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and reasonable legal costs arising from your breach of these terms, your content, or your unlawful use of the service. This does not apply to consumers to the extent such an indemnity is unenforceable under the consumer-protection law that applies to you.
16. Changes to these terms
We may update these terms. We will change the “last updated” date at the top, and for material changes we will give notice by email or in the app before they take effect. Continuing to use ChessBinder after a change takes effect means you accept the updated terms; if you do not accept them, stop using the service and ask us to close your account.
17. Governing law and jurisdiction
These terms are governed by the laws of India, and the courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising from them. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-law rights available to you locally, or of your right to bring proceedings in your home courts where the law gives you that right.
18. General
If any provision of these terms is found unenforceable, the rest continues to apply. Our not enforcing a right immediately is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor operator of the service on notice to you. These terms, together with the Privacy Policy, the Children & Parents notice, and the Copyright & Trademark page, are the entire agreement between us about ChessBinder.
